Type: Draft Ministerial Notification · Status: Draft · not yet in force
Under revision — Prepare in advance: the new criteria will be stricter for many substances.
The revised draft Ministry of Industry notification is undergoing public consultation and revision and has not yet been published in the Royal Gazette. Follow updates from the Department of Industrial Works (DIW).
Details
- Substances to test: Reduced from 126 to 38 substances: Factory Types No. 101, 105 and 106 test all 38; other factory types test 9 in soil and 10 in groundwater
- Background concentration: Background concentration (mean + 3 standard deviations) is used in deciding whether control or contamination-reduction measures are required
- Monitoring wells: At least 2 groundwater monitoring wells, upgradient and downgradient, with sampling locations approved before drilling
- Exemptions: Factories with floors sealed with impermeable material, or using less than 1 tonne of hazardous substances per year, may apply for exemption
- Criteria: Criteria for many substances are lowered to match the Pollution Control Department's groundwater quality standards (see the comparison table below)
Why this is urgent
Draft standards are tens of times stricter: results that once passed may now fail
- Under the revised draft, Factory Types No. 101, 105 and 106 must test for 38 substances, while 9 other factory types must test soil for 9 substances and groundwater for 10 substances
- Background concentrations must be taken into account, and a report proposing measures must be submitted within 180 days of receiving the results
- Sampling locations must be approved before wells are drilled, and both up-gradient and down-gradient wells are required
- The B.E. 2559 (2016) standards remain in force; the revision is still a draft and has not yet been published in the Royal Gazette
